Service Description

FuseHQ Studio provides software development, architecture design, and AI-assisted build services. We turn structured business blueprints into production-ready applications. All services are delivered on a project basis with milestones agreed upon in writing before work begins.

How Your Software License Works

When you work with FuseHQ Studio, you're licensing custom software, not purchasing source code outright. Think of it the way Shopify works: if you run a store on Shopify, you own your products, your customers, and your business data. But you don't own Shopify's code. Your store runs because you're a licensed user of their platform. The moment you stop paying, your store goes offline, but you can always export your data and take it elsewhere.

Your FuseHQ Studio solution works the same way. We design and build a custom software platform around your business. You own your business data completely, every record, every customer, every file, and you can export it at any time. What you're paying for is a license to run that software, supported and maintained by us, for as long as your Managed Platform Plan is active.

This is how we're able to deliver custom software at $2,500–$6,000 rather than the $25,000–$75,000 a traditional development agency would charge. The licensing model is the reason the price is accessible.

If you ever want to fully own the code and move it to your own infrastructure, a Code Transfer Package is available. Because our applications are built on a managed platform, including hosted databases, payment processing, email delivery, AI services, and deployment infrastructure, a code transfer involves more than delivering a source file. It includes the source code plus a full migration to your own independent infrastructure. This is scoped and quoted at the time of request based on your application's complexity.

Your Managed Platform Plan includes a set amount of email delivery and AI usage each month, enough to cover the vast majority of small and medium business applications. If your application sends a high volume of automated messages or runs AI features heavily, we will review usage with you during onboarding and recommend the right plan before development begins. There are no surprise charges, any usage above your plan is disclosed and agreed before it is billed.

Intellectual Property and Software License

Ownership

FuseHQ Studio retains all intellectual property rights to the software codebase, technical architecture, design systems, and underlying infrastructure configurations developed under this agreement. Client receives a perpetual, non-exclusive, non-transferable license to use the software for its intended business purpose, conditioned on maintaining an active Managed Platform Plan.

Client Data

Client retains full ownership of all business data stored within their application at all times. FuseHQ Studio will never sell, transfer, or use client data for any purpose outside of operating and improving the client's application. Client may request a full data export in standard formats (CSV, JSON, or equivalent) at any time at no additional charge.

License Continuity

The software license remains active for the duration of an active Managed Platform Plan. Upon cancellation or non-payment of the Managed Platform Plan, the software license terminates. Client retains 30 days from the termination date to export their business data. The license may be reinstated at the then-current plan pricing at any time.

Code Transfer Package

Clients may request a Code Transfer Package at any time during an active license. A code transfer includes delivery of the application source code repository and a structured migration engagement to establish the application on the client's own independent infrastructure, including database, hosting, payment processing, email delivery, and third-party integrations. Code transfers are scoped individually due to the complexity of migrating managed infrastructure components, and pricing is provided upon request. FuseHQ Studio makes no guarantee that a transferred codebase will operate without technical configuration by a qualified developer.

Platform Acknowledgment

Client acknowledges that FuseHQ Studio's delivery model uses a managed development and hosting platform. The application is designed, built, and maintained within this environment. This is the operational basis for FuseHQ Studio's pricing model.

Managed Platform Usage Limits

The Managed Platform Plan includes a baseline of usage each month. Clients are notified if usage approaches or exceeds their plan limits.

Standard Plan ($250/month) includes:

  • Up to 5,000 emails sent per month
  • Up to 500 AI-powered interactions per month
  • Standard database compute and storage

Professional Plan ($500/month) includes:

  • Up to 25,000 emails sent per month
  • Up to 3,000 AI-powered interactions per month
  • Priority support and performance monitoring

Usage above the included limits is billed at cost and itemized on the following month's invoice. FuseHQ Studio will notify the client before applying overage charges where possible.

Clients may request a usage summary at any time. FuseHQ Studio reserves the right to adjust plan limits with 30 days written notice.

Payment Terms

Project fees are quoted after blueprint review and are typically split across milestones: a deposit to begin, interim payments at agreed checkpoints, and a final payment before full deployment. Invoices are due within 14 days of issuance. Late payments may incur a 1.5% monthly service charge.

Refund Policy

If work has not yet started, the deposit is fully refundable within 30 days of payment. Once work has commenced, refunds are prorated based on completed milestones. No refunds are available for completed and delivered work. Disputes are resolved in good faith before escalating.

Intellectual Property

Upon final payment, full ownership of the custom software, source code, and associated deliverables transfers to the client. FuseHQ Studio retains the right to reuse general-purpose frameworks, utilities, and patterns developed during the project, provided they do not contain client-specific business logic or data.

Limitation of Liability

FuseHQ Studio's total liability is limited to the total amount paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss, except where prohibited by law.

Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Wyoming or through binding arbitration in Cheyenne, Wyoming, at the client's election.
